If you are involved in an automobile accident, there are certain things you can do to protect yourself.
1. Stop, never drive away from the scene of an accident without stopping even in a minor accident.
2. Protect yourself and the accident scene by setting out flares or keeping your safety flashers on. The vehicles involved should remain where they are unless they are interfering with traffic.
3. Call the police, even in the case of a minor injury or no injury at all. A police report will be helpful in filing an insurance claim, especially if fault is being disputed.
4. Pictures, pictures, pictures, most people today have a cell phone with a camera. You should take pictures of any visible damage, injuries and even the accident scene but, be careful not to interfere with the police investigation.
5. Make an accurate record, tell the police to the best you can exactly what happened do not guess or speculate. If you are asked about injuries and are not sure, say you’re not sure. Sometimes injuries are not felt immediately and may become apparent later on.
6. Exchange information with the other party. The police will generally obtain this information but if the police do not respond it is important that you get the name, address, phone, number and insurance information of all persons involved in the accident. It is also important to get the contact information of any persons that may have witnessed the accident.
7. Seek medical attention as soon as possible, even a minor impact can cause an injury. Injuries left untreated can become serious.
8. Report the accident to your insurance company as soon as possible. Many insurance company require immediate reporting and cooperation. It is also important to have your insurance company explain the benefits and limits of your insurance coverage.
9. Keep a file with all accident related documents and information. Include claim numbers, names and phone numbers of all contacts and copies of all bills and receipts for expenses incurred as a result of the accident contact information.
10. Lastly, make sure you protect your rights by consulting with an attorney. Many insurance companies will want to take your statement immediately following an accident. It is important to speak with an attorney before doing so.
